馮滬祥聲請再審性侵案 最高法院駁回抗告
（中央社記者蕭博文台北7日電）前立委馮滬祥被控性侵，最高法院判刑3年4月定讞。馮滬祥聲請再審，但高院認為不符再審要件，去年裁定駁回。馮滬祥不服高院裁定提起抗告，最高法院今天予以駁回。
這起案件發生在民國93年，馮滬祥被控在家中性侵菲傭；被害人在友人協助下，聯繫馬尼拉經濟文化辦事處勞工部職員，陪同前往醫院就診並報警；事後雙方簽下和解書，菲傭拿到新台幣80萬元和解金後返回菲國。
台灣高等法院更六審以強制性交罪，判處馮滬祥有期徒刑3年4月。馮滬祥不服提上訴，最高法院105年10月7日駁回上訴、全案確定。馮滬祥105年10月26日服刑，106年初獲准保外就醫。
馮滬祥去年向台灣高等法院聲請再審，主張女子承認從他的臥室中垃圾桶採得保險套，再塗抹精液在兩條內褲，並指女子回到菲律賓後透過視訊坦承誣陷，但原確定判決卻都未予採信，事實認定有誤。
高院認為，原判決認定事證明確，馮滬祥憑己意任作指摘，不符再審規定，去年底裁定駁回，馮滬祥進而向最高法院提起抗告。
最高法院認為，原判決已說明為何不採信對馮滬祥有利的證詞，馮滬祥所提的證據不足以推翻原確定判決認定，今天駁回抗告。（編輯：梁君棣）1070907
